Due to recent changes to the law in Virginia, we need some additional information from you in order to remain in compliance.

We need ALL owners to submit the form below. There are three pieces of information we are asking for.

1) Legal Change #1 – Requirement to Register Nonresident Property Owners

We need you to tell us your status as either a Resident or Nonresident of Virginia.

A recent change to the law requires any nonresident property owner to provide us with a completed Form R-5 within 60 days. We are happy to submit that on your behalf based on your completion of the information below. In fact, the law requires us to register on your behalf if we do not receive a response from you. (If you prefer to complete the form for yourself, download and complete Form R-5, then sign, scan and email it to [email protected].)

This piece of information will also be used to correctly complete any future leases and/or lease renewals in order to comply with the Virginia Residential Landlord Tenant Act requirement that nonresident landlords designate a Registered Agent. If you are a property management client, we will act as your Registered Agent unless you notify us that you wish to specify a different Registered Agent.

2) Legal Change #2 – “Source of Funds” is now a Protected Class in Virginia Fair Housing Law

What this means is that landlords are required to accept housing vouchers unless they are exempt under the law. Currently, if you own four or less rental dwelling units in Virginia, you are exempted. This will be the case for the vast majority of our clients. Since it is not based just on homes we manage for you in Northern Virginia, we do need you to tell us how many rental dwelling units you own in Virginia.

3) Landlord Transfer Clause

Although not a change to the law, this final piece of information will help us to more efficiently and accurately generate new leases for your property through our system.

Nonresident of Virginia means:
- Individuals who are not domiciled in Virginia or who do not live in Virginia for more than 183 days during a year;
- Corporations not organized under Virginia law;
- Estates and Trusts (1) which consists of real property belonging to a nonresident individual (or Decedent), or (2) that are being administered outside of Virginia
- Partnerships, Limited Liability Corporations, and S-Corporations which have nonresident partners or shareholders who receive income from the sale of rental or real property located in Virginia

Our lease includes an optional clause that gives you, the landlord, the right to terminate the lease with 60 days notice if you are transferred back to the Washington Metropolitan area by your employer or are discharged from active duty with the Armed Forces of the United States or with the National Guard
